Mafatlal had violated non-bailable law

Socialite Sheetal Mafatlal had violated a non-bailable section of the Customs Act when she attempted to enter the country with jewellery but still she was entitled to bail, the magistrate who released her ruled.
The court accepted prosecutor A R Gupte's argument that the offence was non-bailable in view of a breach of notification issued by the Central Government in respect of bringing gold jewellery into the country.
"At this stage, in view of the said notification, prima facie the offence falls in the category of non-bailable offence in view of the punishment prescribed under section 135(1)(i)(C) of Customs Act," Additional Chief Metropolitan Magistrate M J Mirza noted in his order, made available today.
However, the court considered granting bail to Mafatlal after accepting her advocate Satish Maneshinde's argument that searches of her house had yielded no evidence of smuggling and no purpose would be served by keeping her in judicial custody.
